Agreement and operator
These Terms of Service are a binding agreement between the person or organization using the service (you or your school) and Software for Driving School, a Code Expression product (we, us, or the platform). By creating an account, accepting a trial, paying for a subscription, or using the service, you agree to these Terms and the policies incorporated by reference.
If you use the service for a school or other organization, you represent that you have authority to bind it. If you do not agree, do not use the service. Software for Driving School provides software and hosting; it is not a driving school, instructor, DMV, DOT, licensing agency, law firm, insurer, or bank, and it does not sell or supply a school's instructional services.
Eligibility and accounts
Account holders must be at least 18 and able to enter a binding contract. You must provide accurate registration and billing information, protect credentials, use multi-user access rather than shared logins, and promptly remove staff or contractor access that is no longer authorized.
Your school is responsible for actions taken through its workspace, the roles assigned to users, the security of local devices and exports, and prompt notice to support if credentials, records, or payment settings may have been compromised.
The service
The service may include a public website, templates, content management, online enrollment, configurable forms and waivers, document upload and status tracking, student and guardian records, scheduling rules, instructor and vehicle records, portals, reminders, communications history, payment-status records, support, reporting, and optional AI-assisted guidance.
Features depend on plan, configuration, provider availability, account approval, and product stage. We may improve, replace, limit, or discontinue features, provided that material changes to paid service are handled as required by law and any applicable written agreement.
School content and compliance decisions
Your school controls and is responsible for content it enters, uploads, publishes, sends, or collects, including program descriptions, prices, forms, waiver language, policies, student and guardian data, permits, documents, lesson notes, staff records, marketing claims, service areas, and communications.
Requirements vary by state, agency, license type, student age, delivery model, and location. Your school must determine the forms, notices, consents, accessibility measures, instructor and vehicle records, refund terms, retention periods, reporting, and agency review required for its operation. Platform fields and workflows do not create automatic DMV, DOT, licensing, privacy, accessibility, or legal compliance.
Students and minors
Driving-school records may concern teenagers. Your school is responsible for deciding when a parent or guardian must submit information, receive notice, consent, sign, access records, or authorize communications. Do not direct children under 13 to submit personal information through the service unless your school and the platform have implemented a legally appropriate workflow.
Collect only information reasonably needed for legitimate school operations and avoid highly sensitive information unless it is necessary, lawful, and protected by appropriate procedures. Your school must respond appropriately to verified parent, guardian, student, or regulator requests concerning school-controlled records.
Electronic records and communications
You agree that account notices, policy updates, billing notices, support communications, and other service records may be provided electronically. You are responsible for maintaining a working email address and reviewing spam or junk folders when a message is expected.
Electronic signatures and records may have legal effect, but their sufficiency depends on context and applicable law. Your school chooses its forms, disclosures, signature procedure, signer authentication, and retention method. The platform does not guarantee that a configured waiver, consent, or electronic record will be accepted by a court or agency.
Subscriptions, trials, and taxes
Paid subscriptions renew automatically for the billing period shown at checkout unless canceled. You authorize the platform and Stripe to charge the payment method on file for subscription fees, approved upgrades, applicable taxes, and other amounts clearly presented before purchase.
A 14-day trial may be offered to eligible new accounts. Unless canceled before the displayed trial end, billing begins automatically using the payment method provided. Plan prices, limits, and included features are shown on the pricing and checkout pages and may change prospectively with notice when required.
School payments and Stripe Connect
Platform subscription billing is separate from student or parent payments. When a school enables Stripe Connect, the school enters a separate relationship with Stripe and remains responsible for its customers, instructional services, pricing, receipts, taxes, refunds, disputes, charge descriptions, and payment-law obligations.
Stripe may approve, restrict, hold, reserve, refund, dispute, or delay payments and payouts under its own agreements. Depending on the published plan or school configuration, the platform may collect an application fee from eligible connected-account transactions. Any such fee must be disclosed in the applicable pricing or payment settings. The platform does not store full card numbers.
Acceptable use
You must follow the Acceptable Use Policy. You may not use the service for unlawful activity, deceptive claims, unauthorized data collection, spam, malware, harassment, infringement, credential sharing, scraping private data, security testing without permission, payment evasion, or conduct that harms students, schools, providers, or the platform.
We may filter submissions, investigate abuse, preserve relevant evidence, restrict a feature, remove unlawful or infringing content, suspend public pages, pause payment functions, or suspend or terminate access when reasonably necessary to protect users, providers, legal obligations, or service integrity.
AI-assisted features
Optional AI-assisted features may use school configuration, product documentation, and the text a user submits to provide workflow guidance. Do not place sensitive student documents, payment-card data, passwords, or information you are not authorized to disclose into an AI prompt.
AI output can be incomplete or inaccurate and must be reviewed by a qualified human before it is used for a student, payment, legal, licensing, safety, or business decision. AI output is not legal, licensing, financial, tax, insurance, medical, or safety advice.
Intellectual property and license
The platform, software, templates, interface, documentation, and platform-authored content are owned by us or our licensors and are protected by applicable law. During an active subscription, we grant your school a limited, non-exclusive, non-transferable, revocable right to use the service for its internal business and authorized public website.
Your school retains its rights in school content. You grant us and our providers a limited license to host, copy, transmit, transform, back up, and display that content only as needed to provide, secure, support, and improve the service and meet legal obligations. You represent that your school has the rights and permissions needed for content it supplies.
Confidentiality, privacy, and security
We handle personal information as described in the Privacy Policy and Data Processing and Data Security terms. Each party will use reasonable safeguards for confidential information received through the service and limit access to people who need it for authorized purposes.
No internet service can guarantee absolute security or uninterrupted availability. Your school shares responsibility for data minimization, correct permissions, secure devices and networks, lawful exports, staff training, and timely reporting of suspected misuse.
Availability, support, and third parties
We use reasonable efforts to operate and support the service but do not promise uninterrupted, error-free, or universally compatible operation. Maintenance, provider failures, internet conditions, security events, and circumstances outside reasonable control may affect availability.
Stripe, Postmark, Google reCAPTCHA, hosting providers, domain services, analytics, and optional AI providers operate under separate terms and controls. We are not responsible for a third party's independent acts, review decisions, service interruptions, or changes, although we will take reasonable steps within our role to restore or protect platform operation.
Suspension, cancellation, and data
You may cancel as described in the Cancellation Policy. We may suspend or terminate access for material breach, nonpayment, unlawful use, security risk, provider restriction, or conduct that threatens the platform or others. When practical, we will provide notice and an opportunity to cure unless immediate action is reasonably necessary.
Your school should export required records before access ends. We may delete or de-identify school content after termination according to the Data Processing terms, backup cycles, legal holds, security needs, and applicable law. Cancellation does not eliminate obligations that arose before cancellation.
Disclaimers
To the maximum extent permitted by law, the service is provided as available without implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, licensing outcome, legal compliance, or agency acceptance. We do not guarantee enrollment volume, revenue, search ranking, payment approval, student eligibility, test results, or regulatory outcomes.
Nothing in these Terms excludes warranties, rights, or remedies that cannot lawfully be excluded. Your school's promises to students and customers are its own and are not made by the platform.
Limitation of liability and indemnity
To the maximum extent permitted by law, neither party is liable to the other for indirect, incidental, special, exemplary, punitive, or consequential damages, or lost profits, revenue, goodwill, or data, arising from the service. Our aggregate liability arising from the service will not exceed the subscription fees paid by your school to us during the 12 months before the event giving rise to the claim.
The limits do not apply where prohibited or to liability that cannot legally be limited. Your school will defend and indemnify the platform and its personnel against third-party claims arising from school content, school services, your breach of these Terms, or your violation of another person's rights, except to the extent caused by our own breach, negligence, or willful misconduct.
Governing law, changes, and contact
Florida law governs these Terms without regard to conflict-of-law rules, and permitted disputes will be brought in the state or federal courts serving Miami-Dade County, Florida, unless mandatory consumer law requires otherwise. Before filing a claim, the parties should make a good-faith effort to resolve it through written notice.
We may update these Terms prospectively. Material changes will be communicated as required, and continued use after the effective date constitutes acceptance where permitted.
